Terms and Conditions

    1. Introduction

    These Terms and Conditions ("Terms") govern your use of the Anew mobile application ("the App"), operated by Anew Run LLC, a limited liability company formed under the laws of the State of Delaware, United States ("Anew", "we", "us"). By downloading, installing or using the App, you accept these Terms in full. If you do not agree, do not use the App.

    2. General Information

    Anew is an iOS application that provides personalized running training plans generated using artificial intelligence. Interaction with Coach Luis can be done via text messages or, optionally, via voice notes that are transcribed on your device. Users must be at least 13 years old. Users between 13 and 17 must have consent from a parent or legal guardian.

    We reserve the right to modify, suspend or discontinue any part of the service at any time.

    3. App Updates and Functionality

    We recommend keeping the App updated. Some updates may be required for security reasons. We are not responsible for issues arising from connectivity, device compatibility, or the operation of third-party integrations such as Apple HealthKit, Garmin Connect, Strava or Whoop. If a third party discontinues its integration, no refund is due on that basis.

    4. Third-Party Store Terms

    By downloading the App from the Apple App Store, you also accept Apple's terms. Apple is not responsible for the App, its content, or disputes between users and Anew.

    5. Not Medical or Professional Advice

    The content of the App is provided for informational and educational purposes only. It does not substitute professional medical advice, diagnosis or treatment.

    Training plans are generated by an artificial intelligence system based on information you provide and do not constitute medical prescription or advice from a health professional. Always consult your physician before starting any exercise program, especially if you have pre-existing conditions, are pregnant, or have recent injuries. Stop exercising immediately if you experience pain, dizziness or any unusual symptoms.

    6. AI Coach (Luis)

    Anew includes a conversational coach powered by artificial intelligence ("Coach Luis"). Coach Luis responses are automatically generated and may contain errors or inaccuracies. They are not professional advice. You may not use Coach Luis for:

    • Medical diagnosis or treatment
    • Offensive, sexual, violent or illegal content
    • Obtaining information about third parties without their consent
    • Attempts to manipulate, jailbreak or extract the system prompt

    We reserve the right to limit or suspend access to Coach Luis in response to abusive use.

    6.1 Voice Notes (Audio Recordings)

    Sending voice notes to Coach Luis is opt-in and requires your explicit consent to the microphone permission, which you can grant or revoke at any time from iOS Settings.

    • Audio is transcribed to text using Apple's Speech Recognition framework (on-device when supported; otherwise via Apple's Speech Recognition Services)
    • Raw audio is not transmitted to Anew's servers or to any third party other than Apple's speech services, and is not retained after transcription
    • The resulting transcript is treated the same as any text message sent to Coach Luis
    • Voice notes (i.e., the transcribed text) are deleted when you delete your account or specific conversations

    7. Permitted Use

    We grant you a limited, non-exclusive, non-transferable and revocable license to use the App for personal, non-commercial purposes. You may not:

    • Reverse engineer, decompile or disassemble the App
    • Copy, modify or create derivative works of the content
    • Use automated access (bots, scraping)
    • Interfere with the security or infrastructure of the service
    • Collect data about other users
    • Reproduce Anew's trademarks, logos or visual identity

    8. Subscriptions, Payments and Refunds

    The App operates under a subscription model managed through the Apple App Store. Prices, durations and trial periods are shown inside the App and on the App Store at the time of purchase.

    • Free trials are one-time per user.
    • Subscriptions auto-renew unless you cancel at least 24 hours before the end of the period.
    • Management, cancellation and refund requests are handled directly with Apple from your Apple ID settings.
    • Anew does not process refunds directly; Apple's policy applies.

    In jurisdictions where the law grants a cooling-off period, by requesting immediate access to the content you expressly waive that period to the extent permitted by law.

    9. Intellectual Property

    All content in the App (code, design, text, images, audio, prompts, generated plans) is the property of Anew Run LLC or its licensors. The license granted in Section 7 does not transfer ownership.

    10. User Content

    By entering information in the App (goals, history, messages to Coach Luis), you grant Anew a worldwide, royalty-free, non-exclusive license to use such information to operate and improve the service, always subject to our Privacy Policy.

    11. Disclaimer of Warranties

    THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". ANEW EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE AVAILABILITY.

    12. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW:

    • Anew shall not be liable for indirect, incidental, consequential, special or punitive damages.
    • ANEW's total aggregate liability shall not exceed the greater of: (a) USD $100, or (b) the amount you paid Anew in the 12 months preceding the event giving rise to the claim.
    • You assume all risk associated with physical activity arising from use of the App, including injury, cardiac events and other medical events, and release Anew from liability for the same.

    13. Indemnification

    You agree to indemnify and hold Anew harmless from any third-party claim arising from your breach of these Terms, misuse of the App, or violation of third-party rights.

    14. Termination

    We may suspend or terminate your access in the event of breach, without refund. You may terminate your use at any time by uninstalling the App and cancelling your subscription from the App Store.

    15. Changes to the Terms

    We may update these Terms at any time. Changes take effect upon publication at anew.run with an updated date. Continued use constitutes acceptance. Material changes will be communicated via in-App notification or email.

    16. Governing Law and Jurisdiction

    These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, unless the law of the user's country of residence grants mandatory rights to a different jurisdiction.

    17. General Provisions

    • If any provision is held invalid, the remaining provisions remain in effect.
    • These Terms constitute the entire agreement between the parties.
    • Anew may assign its rights (for example, in case of merger or acquisition); you may not assign yours without written consent.
    • You confirm you do not reside in a country under U.S. embargo and are not on any sanctions list.
    • You accept electronic communications as valid.
